Alcohol & Drugs: MIP, MIC, Intoxication minor transporting alcohol (not his)

my son was stopped and ticketed for transporting alcohol. The alcohol belonged to a legal person in the vehicle.Can he be ticketed when it is not his?
 
My daughter was also stopped and ticketed for this. She did not have any alcohol in her system. There was a person of legal age in the vehicle, who bought the alcohol. My daughter was ticketed just because she was driving. It wasn't even her vehicle, she didn't want the "legal" person, who had been drinking, to drive, so she did the right thing, and got in trouble for it?! What kind of law is this?

was it open? if so yes because he was the driver.

sometimes the right thing is'nt the right thing it's all depends on how they look at it. If she was driving than the law looks at it as if it were her car.
