I need to have someone explain this law to me. The other night my son was a passenger in a vehicle with three other people when the police pulled them over. They found an open bottle of vodka in the car and when my son was questioned he stated that it was not his and did not know who's it was. We assume all passengers and driver stated they did not know who's it was. If this is true do all people in the vehicle get charged?

Thanks for your help

The charge was not ownership of the booze but possession; everyone in the car possessed it.

That is how the police handles such cases sometimes………The actions and questioning of the passengers by the cops must have given sufficient evidence or probable cause that they were protecting someone or lying. Since they did not out the real person, they might have been all charged. The cops must have found it hard to believe no one could tell the owner………He however would only have to fight in court to clean his name. It is not surprising…..Don't be surprised if some of the kids start outing others to get a deal or clear their names. Sad but true…………the first who cooperates usually gets the best deal…… Your son will have to show he did not know it was there nor owned it.....
