Hi, so last night i headed up to my friends house whos parents are currently out of town for a while to hang out with some friends. As usual the small "get together" turned into a party, i'd say about 15 kids total were there in the end. No one was 21, a few kids were under 18, and just about everyone had been drinking. A few of the kids who showed up no one really knew, they didnt seem like trouble so no one really cared.
We were all out on the porch, about 20 minutes after the random kids had arrived everyone heard popping and cracking followed by a firework shot off into the sky from the driveway. All of the kids on the porch were pretty upset, went inside to ask who shot off the fireworks and ofcourse no one manned up and took the blame. 5 or 6 minutes later we got a call at the house from some of the kids who just left saying it looked like there was a cop headed up to the house.
The news was broadcasted to the party and as it would be at any highschool or summer party kids freaked when they heard the word cop. At that point, me along with several of my friends and the kid who lived at the house started to pickup the beer cans etc. The other half of the people that were there promptly dissapeared into the forest! not 5 minutes of cleaning had been done when the kids who were left were walking out to the porch to double check for trash saw 2 mag lights shined straight at our faces.
The lights on the back porch showed that it was 2 cops who had walked around the house to suprise us almost in the back. They told us to take a seat and asked for the kids whos house it was to come outside, they called his parents and took all of the remaining kids information. Asked who was 18 who wasnt, if anyone was 21 etc. at the time there is 7 kids on the porch getting questioned, while we sit and listen the cops partner takes it upon himself to go inside and search the house, upstairs downstairs everywhere.
After all our information was written down, they busted out this box with all of the breathalizer tools inside and began to call names to come up and blow into the machine. During this time his partnet started taking snap shots with his camera of single cans and beer left inside the house. He called us one by one, but didnt ask if we wanted to decline to breath test. Ive heard they have to give you an option to decline, but no one really spoke up, so we all blew our breaths and the cop moved his work inside the house.
The 2 kids who were not 18 had there parents called and either were picked up or driven home shortly after. We were called one by one into the house just like for thebreath test to sign a small form, which ended up being my MIP. I have a court date, along with every other kid that didnt run. After i told my parents what happened and showed them the form, we looked up the code online ; 25662 B & G minor in posession of alchohol. it doesnt match what had gone on that night, says that they can only do what they did if it was a public place.
There weerent more than 10 people present when they arrived, the other kids had ran off. so what i was reading confused me when i thought about what happened. Thats about the whole story, just wanted to know if they were allowed to just walk onto the prooperty like that, search the house, breath test etc. ALso, when they showed up no one had any alchohol on them, anyways any information would be helpful trying to gather as much as i can for court.
