Alcohol & Drugs: MIP, MIC, Intoxication MIP For Leaving a Halloween Party

Around 11:30 Halloween night the cops came and broke up my friends party. There was well over 50 people at this party and the majority were under 21. As I was leaving the party a cop noticed that i had a beer can in my pocket of my costume. I had not even walked out of the house before I was stopped and questioned. I had no idea that I had a beer in my pocket of the costume and it was accessible for someone to slip a beer in my pocket as i was leaving. I surrendered the beer without challenging the officer and i told him that i didn't know i was in possession of the beer. I told him that i was 20 and that i was just trying to help them and my friends by filing out of the party with everyone else. Next thing i know is that i am being escorted to a police car and than handcuffed and placed in the back of the car. The officer who spotted the beer than came up to me and said "Do You Think I'm Fucking Stupid, that you can sneak a beer right in front of me". The whole time i was co-operative, polite, and respectful. The officer did not even ask for my drivers license even though i had it in my pocket. They asked if i had been drinking and i said yes. Then the officer who was writing my citation made a big issue about how i was going to get home that night. Most of my friends were at this party were drinking so they could not come get me. I told them that i could call a cab. The cop left me in the back of the car for a few minutes and then released my from the handcuffs to sign the citation for MIP. Then he told me i was free to go. I asked him if he wanted me to find a ride or call a cab cause he made a big deal about me walking home. "I Don't Care What You Do, Leave The Area" so i walked home. I know that i can loose my license for a year for being in possession. I turn 21 in February and I have a clean record. What Should I Do? I want to talk to a lawyer but it sounds like regardless of what i say in front of the judge he/she has to take my license away. I live 12 miles from school and i work 30 hours a week. I have a friend who beat a DUI/MIP by hiring a lawyer. He was pulled over with open containers in his truck and blew below .08. What should I Do?
 
Yes, you need to hire a lawyer.
 
I talked to a friend at work about the incident and he was issued an MIP about 4months ago at Sonoma State University. He received something in the mail about an alternative court to go to. He went and was issued a fine and classes to take but his license was never suspended. I would rather do that then hire a lawyer. But I have herd that the laws have changed since then. What would a lawyer be able to do for me to help me with my situation? I also found out that there was over 200 people at this house party that I was attending if that matters.

I agree with senior judge. Hire a lawyer, as it will cost in the present, but be cheaper in the future.

Even if true, nobody will believe this. It is a plus on your side it seems he didn't have you blow into a breathalyzer.

1 year? that seems ridiculously harsh. I'd check again. In my State DUI peeps don't get that.
