I am 17 years old and was at a dorm party with some friends on the UC Berkeley campus (in August of 2005). While inside the dorm house a friend handed me an empty cup (which had previously contained beer) asking me to hold it for him. Shortly after this I walked outside the dorm and was talking with some friends, still holding the cup. While standing, an undercover policeman (alcohol control unit) grabbed my arm asking my age, name, ect... After finding out that I was 17 he preceded on taking the cup that I was holding, and after smelling it he concluded correctly that it had contained beer. He then wrote me up for a MIP. While writing up my citation I asked if my license would be suspended. His answer was no at first but another officer (Berkeley P.D.) came over and corrected him saying that it would indeed be suspended for a year in addition to fines. They then took me home to my parents.
Is this a case where my license needs to be suspended or can I argue that at most I just deserve a fine and/or community service?
Is there any advice that you can give me in order to keep my license?
