Im an 18 yr old who just got an mip in michigan when my friend was driving and i was in the passenger seat(He got a OWI). I had a .06 aclochol level, which is .02 under the limit in michigan. I was told be some people that i must plead gulity or I will automatically get the hardest possible penalty. But i dont know how i can plead not guilty when i had a .06 alcohol level. Please help.

Thanks

The limit in Michigan for an MIP is .02. Sorry. Only chance you probably have is the officer had no right to give you a PBT. Did he read you your PBT rights?

he didn't read me any rights. He just asked me if I had anything to drink and i told him i did since i figured he would give me a breathalyzer test anyway. so all he did was give me the breathalyzer, patted me down, and dropped me off at Meijer to find a ride home. Im going to court tomorrow morning, and i have no idea what to do right now.
