I was issued an MIP a few weeks ago, but I was not intoxicated. Although long, this is the exact story of what happened:

I was going to meet some friends of the person I was with who lived in a "dry" apartment on Grand Valley's campus. This should come as no shock to anybody here because the campus is known to be "dry". Because the campus has a no-tolerance for alcohol the apartment is still much like the dorms and have Resident Assistants (RAs).

When we arrived at the apartment there were alcohol containers everywhere and everybody there was with no question intoxicated.

After two minutes of being there the RA showed up followed by three officers. The officers asked if anybody had been drinking. Everybody cooperated and confessed that they had.

Earlier in the evening I was at a friend's apartment where I had a couple sips of champagne to celebrate their birthday. I had told the officers that I had just gotten there minutes before and had nothing to drink recently, but that I had a couple sips of champagne much earlier in the evening. However, the officer wrote on my ticket that I had consumed an entire glass which is completely false.

Knowing that I was innocent I had asked for a PBT and the officer had said, "With the new law we no longer deal with PBTs and we just do a sobriety test and I can tell from the look in your eyes you've been drinking." Even though I had confessed to something that I technically shouldn't have I feel as if I should have been given a PBT to legally prove my innocence.

I was obviously in the wrong place at the wrong time and would not be so worried if I thought I deserved the charge.

I am well aware that even though I know I was not intoxicated that because I said I had something to consume earlier and somewhere other than where the ticket was issued that it will clearly still be used against me in court.

My court date is scheduled for two days from now and I won't be having an attorney present. I was wondering whether I should plead guilty or not guilty?
