I am 19, reside in Michigan and was on the sidewalk in front of my house holding a glass that was a quarter full of vodka and tonic. A cop appeared from behind a tree and told me that if I did not tell her what was in the glass that she would "take my butt down and throw me in jail." Obviously, I was scared that I would have to go to jail and admitted to having vodka and tonic. (I was by no means drunk or even close.) She did not give me a breathalyzer test but wrote the MIP ticket.

My question is...since there is no breath test can I deny that I had vodka and that she intimidated me into this ?

It will be your words against her . You will have a court date at that time you either plead guilty or not . If you plead not guilty the judge will set a trial date in the future and it's your words against the police officer . If you plead guity the MIP punishement in Michigan for first offense is $100 fine + community services + substance abuse treatment classes . No action on your driver license. After you're done with all of the probations your record will dismiss for the first time only .
