Alcohol & Drugs: MIP, MIC, Intoxication MIP in Texas

I have a 17 year old son who received a MIP. He was at a friends house and drank then went to a party(they had a designated driver) at the party he was standing around a truck that had 2 open containers in the bed and beer locked inside. It wasn't their truck and they had no beer cans in their hands. The officer asked my son if he had been drinking and he told him yes. The officer said since he had been drinking he was MIP, Is this correct? He didn't take a breath test.
