Hello all, i reside in temple texas. Last night at some apartments i was stoped by a campus poslice officer. I had a brown bottle in my hand, much like a beer bottle, She never looked at the the bottle, or touched it, or came within 5ft of it. Yet she wrote me a ticket for minor in possession. What kind of evidence does she need to prove this was a MIP? Then she wrote a ticket for MIC, i asked her for a breath test, she refused to give me any test, she said im under 21 i do not have that right? i dont think she was right. SO she did not test me and wrote me a ticket for MIC. When you asked for my ID i had none she took my DEBIT card, asked when my birthday was i said 7/30/86 but she called in 7/30/82 this was all verbally, she had nothing physical saying i was 21. She wrote me a ticket for a Fake ID??and on the warning section of ticket she wrote it was at a place of higher education, when it was actually at some apartents across the street from the junior college. I plan on contestinga ll of this, because she never had any beer that belonged to me or that i had in her hand. She REFUSED to allow me to test, that is my right correct? and she gave me a fake id ticket for a verbal exchange of dates? do you guys think this will hold up? thanks

and she never picture I.D.'ed me if that makes any matter of difference. She took my bank debit card and ran a search on my name. And the bottle, all she saw was a brown bottle she CANNOT identify it. or explain where this bottle i "had" went. She has no physical evidence. I told her my birthdate was in 82, when in all actually it was 86
, but she charged me with a fake id wich i didnt have, not giving misinformation to a police officer, how is that gonnna play out?

She said my breath smelt of beer, but how can that be, i was at minimum 3ft from her at all times and 6 inches above, plus i was chewing gum and smoking a black and mild, yet she says she smelt in on me. So i asked for a breath test. and refused and refused to give me one. So she didnt know for sure what this brown bottle was, she didnt know if a friend spilt a beer on me, she didnt know if i had actually been drinking. Im just wondeirng what kind of chance does it look like i have guys. if i were somehow convicted guilty on all charges it would be around $1500 wich me being at a univeristy doesnot have.

Ok after arguing with the campus police officer, he said i could come and pick up the police report. So i drove there and went in. He gave it to me, then issued me a criminal tresspass notice for going up there! he signed it, placed my name on it but the witness line is blank? does this deem it invalid? In the police report, wich is filled with spelling and gramatical errors, she says i was was in possession of an alcoholic beverage (bbeer), yet she never states she saw me consuming it or that she identified the brand or any other details about the beer. The police report says under Crime: MIC - Alcohol, and makes no mention of the MIP except in the narrative, and on the citation. Can anyone out there give me any advice?
