Recently, I was pulled over and had two bottles of alchohol in the car. I was a DD for the night, and the alchohol was mine, but it was my friends in the car who were going to drink them. Anyhow, I got an MIP. (The other two didn't, even though they are my age).
In short, the officer found the bottles and put them on the car and after some questioning, wrote the ticket, and told me to put the bottles in the trunk next time. This is where my question comes in: Shouldn't he have confiscated the alchohol? I am a minor and he just let me go with them. I was wondering if this is proper procedure or not, because I was under the impression they were supposed to either take the alchohol with them or empty the contents of the bottles, but he did neither. Technically speaking, he was in possesion of the bottles, and then he gave them back to me. Would this not be giving alchohol to a minor? Once he had them in his posession, he should have kept them.
This is just my theory and because this is a first offense, I was wondering how things normally go and what to do from here. Any advice in general or tips on what to say in court? Thanks.
