Alcohol & Drugs: MIP, MIC, Intoxication MIP Passenger in Michigan

My freind was driving to the store to get some pop and he was pulled over for a tail light out. He was not drinking. Passengers in his vehicle were myself, my girlfreind, and a another freind. The other freind was drunk. However, my girlfreind and I were not. The officer asked if we had been drinking and we expressed that we had shared a beer hours earlier. Three of us received tickets for MIP Passenger and the driver received a ticket for the tail light. One thing that baffles me is, the officer did not give me nor my girlfreind a breathlyzer test. There was no way we had alcohol in our system. Can anyone explain the law in Michigan that justifies how this cop could issue this ticket without proper evidence that we had alcohol in our system. I thought minor in possession meant that you had alcohol in your system or had open container, or any type of illegal substance in your possession under age.

Sounds like you admitted to him that you were drinking. That's all he needs. It's like admitting how fast you were going, etc. Hopefully there isn't a next time, but silence is the way to go.

MIP that I do not deserve

Hi,

This weekend I had a run in with the law and I was wondering if you could give me some advice on what I should do. I was at Central visiting some friends and I got a Minor In Possession. I was not drinking at all, had no alcohol on me, and had no intention of drinking. We were driving to an apartment from my friends dorm and we were pulled over for having an out license plate light by a State Police car with two cops in it. I was sitting in the front seat and there were a few people in the back as well. The police officer asked if we had anything in the car that we shouldn't have had and the driver said that there was some beer in the trunk. Which was his and one other guy that was in the car no one else's. So the police proceeded to give everyone in the car MIP's. I have a court date November 6th for the arraignment and I was wondering what I should do. If you could get back to me on this that would be great. Thank you for your time.
