Alcohol & Drugs: MIP, MIC, Intoxication Mip Rights

Ok, I was over at a friend's house partying and drinking. I am 18 years old. Everything was going just fine, having a good time. Then I went up stairs to go to bed and my car was stolen when I was sleeping and the kid that stole it hit a tree with it. Now the next morning when I woke up, there was a sheriff downstairs at the table and I walked down there and he told me to sit down. He proceed to tell me that he was going to give me a pbt and that if I didn't take it, he was going fine me 170 dollars right on the spot. I was just wondering if that was legal for the cop to do. There was no alcohol where the cop could see it and I was upstairs sleeping. How could he give me an mip if he didn't even know I was drinking and if he didn't even know there was alcohol in the house. Oh yeah the kid that was driving me car was drinking and he had to go to the hospital and when he got to the hospital, that is when the cops were called. I don't think that I should have recieved that mip. Tell me what you think as soon as possible, I have court thursday and it is monday right now. Thank you.
