I was with two of my buddies trying to find a camp site. We couldn't find the campsite and decided to stop at the public parking lot and meet some friends who would show us the way to the camp site. Unfortunately for us the parking lot was day use only and it was around 11 pm. The cop had us role down the windows and he looked inside the car and saw a case of beer sitting in the back seat that i had not even noticed nor did i know was there (it was 99% hidden under some blankets) the beer belonged to one of my friends and we were all sober and the case was unopened. The cop charged all 3 of us with minor in possession of alcohol.
My question is:
Is there any way the three of us can fight this to get the charges against the driver and myself dropped in court with the other friends statement claiming the beer.
I am currently enrolled in diversion for a DUI and it violates my agreement at the start of course and will put the felony on my record for life if the charge isn't dropped. I had no idea it was in the car because they came and picked me up already on their way out to the campsite.
Any help is appreciated.
