Alcohol & Drugs: MIP, MIC, Intoxication Mis-Charged

Here is my situation, and I will follow with some questions.

About a month ago, a search warrant was issued on my apartment. Detectives came in and searched my apartment in suspicion of me selling marijuana. They found pipes, baggies, and a scale, but no pot. They brought me in and asked said they had been working with an informant who was buying pot from me. They asked me if I wanted to cooperate with them to 'work up the chain' and I inquired as to what that meant and we proceeded to talk in an interview room at length about busting my dealer whom they already knew. I told them I would think about it, and they said they would release me if they took a recorded statement.

They recorded a statement in which I admitted to selling pot. Only an ounce at a time always in eighths (3.5 grams) or quarters (7.0 grams). I also mentioned on the tape that I only sold to about 5-6 close friends in order to smoke myself for cheap or free, all of which is completely true. They asked me when the last time I sold a bag was and it was right before they came in and it was the last of my stuff. I learned through questioning whom the informant was because of the small circle I run with. Also, they took back the $60 out of the cash I had for the 3.5 grams I just gave to the person who left. They released me without charging me or booking me on anything and the detective mentioned that he would call me back to work on my guy to get me out of trouble.

Three weeks pass by, no call. Four weeks later, an arrest warrant is issued for my arrest. I am stopped in my car and sent to jail on:
Three counts of Class 4 Felony: Delivery of Cannabis 10-30 grams

The charges list specific dates last year for the individual transactions and don't even mention the last one that they took the money back for. They mention that I sold between 10-30 grams to a confidential informant on those dates.

I bonded out and am awaiting court.

The reason I am writing here is because I have never in my life sold anyone 10-30 grams, so I know that the charges are false. I believe that they had an informant and this person bought from me, but I am confident that this person was never sold anything more than 7 grams. I am confident that I have never sold over 7 grams of cannabis in my life.


My questions:

What would bring about a bumped up charge?? Is it possible that they are able to put a bunch of delivery's together in to one for amount and conviction's sake?

Is it possible that I will be forced to plea out because a cop or informant may get on the stand and lie anyway??

Wouldn't the drug task force have to keep strict tabs on how much money they give the informant and how much drugs come back??

Can I rely on a public defender to fight this case for me, or should I buy a criminal lawyer?

Does my admitting to selling pot allow them to pretty much charge me with anything they want since I have already incriminated myself?

Also, any ideas on possible sentencing if I were to plea out? I live in Illinois and only have one past misdemeanor conviction of drug pariphenalia.

Any other advice you can give me on my situation??

A: I don't know and yes.

A: You will not be forced; you may have a trial if you wish.

A: A public defender is a criminal lawyer.

Sounds like they are putting pressure on you to roll on everybody else. Get your own attorney and quit dealing unless you really have a preference for beans and potato salad. You are marked.

So...

You are saying then that you believe an outside lawyer will do a better job than a public defender???

Also, does anyone know the significance of a Motion of Discovery? I was told about it and how it would allow me to see exactly the evidence being used against me?? I feel like it can't be that easy? can someone explain.

Is there anyway to try to plead to the lesser dealing charges (0-10 g, misdemeanor) which I actually did, based on the evidence released in the Motion of Discovery without going through a trial???
