Shoplifting, Larceny, Robbery, Theft misdemeanor larceny

I was arrested for shoplifting a week before Christmas with $130 worth of items that were returned. I was charged with misdemeanor larceny but the catch is that I was also caught back in September and was given just a citation to appear in court. So I went to court for the September case which was continued. This past week I went for the December case and they offered me the first offenders program and said they will dismiss the one from September and it will not be on my record but this one will be, and I also have to pay The store $5.00. I go back to court on 1/13/14 and I have to bring $5 for The store, but what is confusing to me is the first offenders program. Isn't it supposed to expunge your record? Can someone please exoylain this to me because I don't want to say yes to something atnd set myself up!

First off it was unwise to name store on public forum. Next it your first offense they are expunging as I read your post. Your second offense will be on your record. It appears they are doing you a favor and keeping this from being a second offense. I consult for people like you all the time in this type situation I would enhance your chances at light sentence by taking and completing an Anti Shoplifting program like one offered by non profit group NASP. I advised a client to this before and Judge was so pleased he dismissed case on the spot. Cant say same will happen to you but it can only help. You can take course online and never leave home to complete it
