Recently my 20 year old was involved in an incident where a lady was waiting to get into traffic at a stop sign for an extremely long time. He finally had enough and blew his horn. The lady flew out of her van screaming he hit her. He was about a foot away according to him. She walked around his truck and took his plate number. She pulled out and he came home. Turns out the lady called the township cops and said she was hit. They showed up a few hours later. He is now citations for disorderly conduct (he did get vocal and abusive), careless driving, following too close, and failure to exchange information. The tickets arrived on Saturday but no accident report. I will pursue getting a copy of the accident report. Also, the year of his truck is listed as 05 when it is acutally an 04. Can the traffic tickets be thrown out due to this? If so does he need to plead not guilty and got to court so the tickets are not reissued?

My advice would be for him to retain an attorney. Try the find an attorney link on this site.
If no one is listed send me an email and I can provide some references.

The officers did not witness anything so the tickets are issued on her word and she will have to appear or the tickets will have to be dismissed. I assume that the disorderly is not with the cops.

Another problem is the exchange of information. If she left the scene then how could he exchange info. She probably is using the excuse of road rage and sounds like he gave her that excuse.

He is old enough to know that the way to handle such a situation is to get to the nearest phone and have the cops come out. The first one that enters a report usually has the upper hand. The truck year is of no importance.

Go to the police station and get all of the information including the officer's notes. You may have to file a discovery request or a FOI request. The attorney will need this info. Take pictures of the front of the truck from several close angles. Hopefully there is no damage to substantiate her claim.

Thanks, yes the disorderly was not with the police. No, there is no damage to his truck. The first officer that came to the house looked and had no problem. The second officer showed up with attitude. Even my 24 year old said he the officer had a problem

What you have is the typical "he said, she said" situation. Get the information and go from there.
