My jurisdiction is: Tennessee

I recently lost a civil action. On Apr 4, to be exact. I am supposed to pay 40k to a guy who beat the hell out of me. Anyway, my lawyer called no witnesses, I even asked about it. I feel that I was betrayed. My question is, if I fire this guy, can I use it to base an appeal? I believe if I had called witnesses to support my story, I could have proved (1) that I had not been drinking, and (2) I am not, or ever been, a violent person. Please help

Neither (1) nor (2) will win you an appeal. You would need to prove that you didn't beat the hell out of the guy or that he didn't suffer $40K worth of damage.

It's very difficult to appeal a civil sit based on alleged inadequate representation. You are entitled to hire the lawyer of your choice, and he was good enough to pass the bar, so there you go.

You might be able to sue him for malpractice or file a complaint against him with the bar association.
