My 19 year old daughter was issued a speeding ticket in NC. The trooper said she was going 63 in a 55 mph zone. When she showed me the ticket there is no violation checked on it or any information that indicates that she was speeding. There is a date of the ticket and a date for the court appearance. The only thing that we know is he told her that she was speeding. Do we have any way of getting out of this charge.

Check the statute number on the ticket. In NC a 9mph under does not effect your insurance so I would just pay it rather than take the PFJ.

If there is no statute number you could show up and make a motion for dismissal since no violation is indicated ont he ticket.

I not sure if I asked the question correctly, what I ment to ask is this a charge that can be dismissed because there is not a violation on the ticket anywhere? Is this something the DA or clerk of court can do, or must we go to court and make the motion there?
I don't see a statute number on the ticket anywhere.

You can show up on your court date and make a motion for dismissal. Only a crystal ball can tell you how the judge will rule. Suggest that you look at the ticket again. I have never seen one issued without either the speed or statute number but it is possible the officer was in a hurry. It is also possible that the one he filed with the court has the information, otherwise it could not be entered. You might want to stop by and see what is on the roster.
