My best friend was married in Missouri in 1989. They are now divorcing and it has been determined that her divorce from her husband was not finalized until 1990. When they were married neither of them were aware that the divorce wasn't final so there was no intentional deception. Her spouse has moved out and has systematically taken many items of value that they worked together to pay for and she has been told that since they have not yet gone to court, there's nothing she can do to stop him. He is being verbally and emotionally abusive and is supposedly taking her dog today, just because he can. The doctor she works for bought the dog for her as a gift and the spouse has no interest in the dog; he's just taking him to hurt her. She is at work and can't stop him from going in and out of the house, even though he has officially moved out and signed a lease. He has taken more than half of the furniture and many items that have absolutely no value to him other than it is something that she is attached to and will cause her pain to part with. Her concern is that he is taking things that she worked to help pay for and she will not get any of it back, especially now that the divorce/marriage issue has come up. They were married for 20 years, their home and all of the property that they own is paid for. There is a loan that they must pay and they own 6 vehicles, and only one is not paid for, which is the one she drives. What are her property rights in this situation?

She needs an attorney and the attorney can determine if filing for a restraining order is proper.
