I live in Los Angeles, CA and run a production company. Approximately 3 months ago we hired a few performers for a project. Actors were on payroll and were expected to get paid several weeks after production. However, their agreement specifically states that payroll could take up to 6 months. Though it was never our intention for payment to take that long, we have not yet received payment from the company that hired us. Unfortunately, performers that were hired through an agency are still waiting to get paid. The agency has called us numerous times threatening if we do not pay within a week, they will post to all other companies that we do not pay our actors.
We have explained this situation and just can't pay everyone until WE get paid from the company that hired us. We have no formal contract with the agency, just the contracts that were signed by each actor. Do we have legal rights if the agency decides to defame our company? If so, what are they?
