My ex filed a motion to modify/terminate my alimony on 8-18-08. The judge granted it based on I did not appear. I was not aware we had court. The marshall left the summons in my front door which I do not use I filed a motion to re-open the motion based on I was not served in hand and was not aware I had court. The judge denied it. I filed a new motion for modification asking to re-instate the alimony since I have zero income. Now my ex's attorney filed a motion to dismiss my motion saying the court gave up its jurisdiction in terminating the alimony obligation, once terminated, alimony cannot be restored. Is this true.My divorce orders in JUne 2001 gave me alimony for 10 years(June 2011) I have court this Monday 12-22.

If you have zero income you need to get a job now.

Not checking your front door is really not acceptable. It could easily be seen as dodging the summons as well. You were legally served at an address that was valid. I don't know what else to tell you but the judge has already denied you.
