my son is 18 years old and has had no contact with his bio father for 5 years. He wants to change his last name to his step fathers. He and his girlfriend who is 21 are expecting a baby, can they use the step fathers last name on the baby's birth cert if my son's name is not changed before the baby is born. The mother refuses to use her last name as she does not get along with her parents.

If the age of majority in your state is 18, then your son should be able to change his name legally to whatever he likes. If not, then he will need his father's permission.

I believe that the parents can put any name they choose on the birth certificate.
