Money owed

In 2001 I loaned my step-son, who was unemployed at the time $5000.00. No official payment arrangements were made and he agreed to pay back what he could when he could. Some payments have been made but not as I feel they should have been I know he and his wife can afford to pay more. I tried to collect by sending a letter to his wife's work and contacting her father in another state and no one would help me. I have the copy of the cancelled check and a letter where he agrees to pay $50.00 per month. Can I garnish his and his wife's wages and/or put a lien on their property for the amount owed plus interest?

A: Yes, after you file a lawsuit against them and get a judgment against them.
 
Q: Can I get money form both of them even though only the husband signed the check?

A: I don't know who you can get money from since I do not know them. You can, however, get a judgment against whoever agreed to borrow and pay back the dough.
