Money stolen from personal bank account

I have a ex employeer who, after our working relationship ended due to him wanting more than a working relationship (fired for not sleeping with the boss), illegally entered my home and among other things stole personal bank info. He then used these to pay the company cell bill (which I had one but was never responsible to pay any of it) and personal auto payments. I have documentation authenticated by the bank stating it went to him and his company and all required info. When I went to mediation the other side had no evidence to present and wouldn't settle so we are going to trial. The mediator says that is is a criminal case not a civil one. is this true? I don't want charges filed on him all I want is my money back. How should I handle this? In Washington state we aren't allowed lawyers in the court room for small claims but i feel i need advice.

What is more important to you - your money or your relationship with this guy? Theft is a crime punishable by law. If you want to see your money, there is your answer...

If I where to pursue it leagally, would the best suggestion be criminal or civil (small claims)? All I want is my money back.
 
If the amount is under 5K, you have to pursue it in small claims court. Good luck to you!
