I have been moved out for 3 months now and I still pay 1/2 the mortgage but my soon to be ex husband now has is girlfriend and 2 kids living with him part time not to forget her dog. I feel that I shouldn't have to pay the entire 1/2 of the mortgage do to her living there, do I have any rights with this problem. Currently we do not have any lawyers do to the cost of them so I filed for divorce by myself the final hearing is in Feb. We also made an agreement which we both signed and dated which was filed with the courts also, but he has broken the agreement is there anything I can do about this issue as well. He was suppose to sell my motorcycle and use the entire sum to put down on the credit card but instead he bought another car and told me that when he sold his truck that money would go to the credit card but when he did sell his truck he didn't put any towards that credit card and I haven't seen any of the money if I am intitled to 1/2 what can I do?

In your seperation agreement, did you agree to pay half the mortgage? If you did, then you are stuck unless you can gey this changed. Realize if you don't pay it and your husband doesnt pay, the house can go into foreclosure. You should see about selling the house instead, or him buying you out.

house is for sale and yes I did sign but that was before his girlfriend and kids moved in. He didn't even tell me she was moving in and shouldn't I still have rights to the house because I still do own half of it. NO he won't buy me out I've asked and I already talked about bankruptcy but he said over his dead body. Talked to mortgage company also and they said that they won't help us out either.

The agreement that we made up was just a list of terms that I typed it wasn't anything from the court but I did file it with my divorce paperwork though. Any suggestions on how I can pay less do her living there?
