I was referred to a woman whom I'm going to refer to as a 'broker' for various Mortgage companies. I needed to refinance my home mortgage, and then needed a new mortgage to purchase a commercial property (my business has been operating out of this building for 7 years - I've been renting) The owner is 91 years old, and has changed his mind MANY times over the years when he said he would sell....he'd back out halfway thru my process of getting a mortgage, or somewhere along the line...he'd change his mind. We finally nailed him to a sales agreement! This 'broker' supposedly had our commercial mortgage in process. I have supplied her with all the pertinent information needed. (First problem - she was very slow. We applied to refinance Nov. 26th - we finally settled on the refinance of our house on Jan. 18th) Fine...it's done. The night we signed those papers, she assured me everything was going along smooth and settlement would happen on the commercial property Feb. 15th (which is final day the sales agreement is valid) Since that night - I have NOT been able to contact her. I've left dozens of messages, left notes at her office, tried various other ways to find her, and she has disappeared! My agreement is done Fri., Feb. 15th. What am I to do? The owners lawyer says he can probably get an extention (that is if the old guy doesn't change his mind again!) What legal action can I take against this person 'broker' since she left me hanging? What if I am now not able to purchase the property? I informed her about all of these scenarios, she knew I was very nervous about getting this to happen by Feb. 15th, and she understood all the circumstances! I may end up in bankruptsy court if this doesn't go thru! Do I have a leg to stand on?
