Mother Refuses To Disclose Location

I'm in the process of petitioning the court to establish my paternity, and then I'm filing for majority custody of my son. The situation is, my ex-girlfriend is currently living with me, but she is about to leave and go live with her brother and sister in law, and has stated that she refuses to tell me where she is living, except that it is in a town nearby. I have been supporting her completely since the birth, and even though we both know for a fact that I am the father (via over-the-counter DNA test by IdentiGene), she refuses to recognize me (legally) as the father, because if she has no father declared, she can get better benefits from the government (I have her on tape saying that). She is unemployed, has no transportation, and is otherwise homeless. I work full time, I am taking classes online to be a paralegal, have my own car, and I have my own apartment.

The papers I have hired an advocacy group to prepare for me to make my legal argument before a judge may not be ready for another two weeks, and I think she is leaving in the next week. If I don't know where she is, how can I serve her papers? How can I proceed in my case? Does simply doing something as childish as moving out, taking my son with her, and refusing to tell me where she lives put my custody suit to a halt? There's GOT to be a way to force her to appear, right?
 
You have to have her served. If she disappears, you're perhaps going to need to hire a PI to try and find her.

The difficulty you have is that legally, this is not your son. Mom is free to do whatever she likes and take the child with her.

She's not going to be homeless if she's living with her brother, and the unemployment and lack of transportation won't matter a jot in a custody case.
 
If I can prove to Health & Human Services that she lied about not receiving help from the father, and I present her recorded admittance to intending to defraud the needy assistance system, doesn't that do something? Can I at least get the court system to disclose her location? She has to have a listed address to get Medicaid, WIC and housing, right?

Nope. It absolutely does not impact your situation.

Can I at least get the court system to disclose her location? She has to have a listed address to get Medicaid, WIC and housing, right?


And her address is, legally, none of your business at this point.
