When the mother and I first met, she had a daughter whom was 3 months old that the real father had nothing to do with her whole life. I took all responsibilities of a dad to the child and have been for 4 years. We also have a daughter together who will be 1 next month. I understand that by legal terms I cannot get any visitation of her child due to us never marrying and me not adopting her. We considered it and talked about it for years but money situations held us back. Her daughter has become "mean" to her mother because she won't let her see me and she gets mad as well because her sister gets to see daddy but she doesn't and I get the blame for it.
Anyways, my point in this post, there was an order of protection placed on me by her and she included the kids as well but later took the kids off of the order when we went to court and the Judge ordered for me to get visitation to both girls upon mutual agreements made between me and their grandmother due to the OP. It went ok for the first week, i was able to visit with both girls for 2 nights. After that I attempted to contact her about seeing the girls again but always had an excuse but I never gave up til she finally got aggravated and told me it wasn't gonna work that the Judge would have to decide. After that, I hired a lawyer and we served her custody papers and went back to court. The Judge then granted me every Wed-Thurs and every other Sat-Sun with both girls and is written on the OP.
The first meeting to swap the kids we met at the designated place as assigned and my father went with me to be a witness if anything happened. The mother then proceeded to lock herself in her car and call the local police to try to get me in trouble for violation of the OP. They showed up and pretty much laughed at her and aided in transferring my child to me. BUT the mother didn't bring her daughter as ordered by the Judge until everything was finalized. It has been over 3 months now since I have seen her, but the mother still lets me see my daughter on the designated days.
So in conclusion, can I file a motion of contempt for her violating a court order? What would happen if i tried? Is there anything I can about the mother keeping me from her? Is there any type of law pointing me as a legal guardian of the child as I have raised her and provided for her for 4 years? Any help or information would be highly appreciated.
