I need to know how to get a copy of a incident report. I'm assuming through a motion for discovery. Do I have to go to the county clerks office to file? Can I represent myself in a simple traffice matter? How do I know I'm filing the correct motion for discovery doc?

Offense is as follows: A public citizen managed to get me pulled over by MOHP, claimed I passed a vehicle in an "unsafe" manner, HP issues me a ticket based on citizens word/statement. Of couse it's my word against his, but this is a small town of "good ole boys" and they all have breakfast together.

I need advice on how to fight this case. It's absolutely ridiculous!!

Thank you!

Discovery depends on the rules of the court in your state. In some states no discovery is allowed at the traffic court level and I don't know what you would accomplish anyway. You can contest the ticket and the citizen will have to show for trial. The officer cannot testify since he has no personal knowledge provided you object to any hearsay.
