I want to take off a collection that is posted on my credit report. I was sent to collection from a former college where I was taking some classes. I thought I had paid it but I have no proof so I paid it again but now I realize that the collection on my credit report is driving my credit score down that I can't take advantage of the mortgage rates currently. So I want to file a motion to vacate in hopes that the creditor which has already been paid won't show up and I win by default. How do I file a motion to vacate in NY and do I need a lawyer to do it? Thank you in advance for any help.

If I understand you correctly, the judgment has been paid and (I suppose) satisfied.

If that is correct, then there is nothing to vacate.

Stand by for others who may know something about New York law.
