I had a great job for 12 years and have sole custody of my 14 year old son. His Father has rarely been involved and has visitation that he never requested despite residing less than 3 miles from us. I have sole custody because my ex is impossible to deal with, argumentative and there was domestic violence in the marriage. He was extremely unreasonable in mediation as well as in the Court room and 9 years ago the Judge got to see what I dealt with on a daily basis.
I have dealt with ongoing medical issues since 2006 and recently quit my job. I have an excellent opportunity to get my Bachelors in Nursing on a 3 year program which will require a move out of State. My son wants to go with me but as soon as I sent notification of intent to move my son out of state, my ex is now Father of the Year material and wants his visitation. He had 30 days to file and waited until day 28. He had my son for 3 days recently (first time since another visitation / custody issue in 2007) and couldn't deal with a 14 year old and his attitude. They were both calling and texting me for help. My son did not want to go back and says all his Father does is sleep when he's with him.
There are other parenting issues, to include my Son using marijuana at his residence with his half brother. Are the Courts more likely to rule in favor of my child staying in Arizona with a Father he doesn't know or like, or if my son voices his wishes would they allow him to move with me?
