If I currently have a joint legal and residential custdy order in Delaware, can my ex-husband move to another state (New Jersey) without my approval? I am concerned since I cant imagine that one states official can uphold another states laws. Also if he has begund a new relationship, can he travel to another state with him (New Jersey) spend the night and leave my son in her care all without my knowledge?
 
He can move but the child wont be able to move with him. If it is turn with the child then he can take the child with him as long as he is back when its your turn to have the child unless the court orders say otherwise. If he can take the child with him he can leave the child in his gf's care. Good luck.

1. Yes. An adult person does not need permission nor approval (sans court order) to move in this country.

2. Yes. The child father may take take his child to another state for visitation for his time as long as it doesn't interfere with your visitation, disregard the CO or child's schooling. Father does not need to get your permission for who he deems fit to care for his child on his time.


Non-legal but IMPORTANT advice: Read some CO-PARENTING books or take a co-parenting class so your need to control everything will "fade".

No need to be concerned - you simply go back to court and have the custody order modified based upon the change of circumstance.

Jack's gal asked a good question.. is Dad moving from Wilmington to Camden, for example?
