To whom it may concern:
My questions consist of the following:

1) I was married from 1980 to 1997. I was a stay at home mom, and had one child, who was born in 1983. I have a disability, and have not been gainfully employed since 1980.

2) The father of this child, remarried in 1998. They are presently separated, not legally. This took place in August of 2008. She had a career before they married, and while they were married continued in being a co-owner of their business. She cannot have children. She is now currently running his business. He has taken a back seat and is not working.

3)My questions are: who is the main recipient of his social security,when can I apply for it, what rights does my daughter have with the situation as it is, as it relates to his inheritance, his business, etc.

Not sure what your questionb is but if dad is on social security diability then you should receive a benefit. Anything incone or assets that belong to his wife you have no claim too. Your daughter does not have any automatic rights to inheritance that is up to the laws and probate laws in your state and this only becomes an issue if dad passes away.
