I was married 7/01 and my husband moved out 8/02. I moved to Texas for a job in 2003 with the understanding my husband would join me there. In order to buy a house in Texas I needed to include my husbands name on the house. Despite promises to reunite, I was pressured to sign a legal settlement agreement from NY, which I did in 2004. He moved to California and filed for divorce in 2004. For the past 4 years he has sent paper for me to sign and fill out for the divorce, but everytime I have done this nothing happens. He has changed lawyers 3 or four times. Now it has started up again. But, at this point I would like to ask for $5000.00 more which are expenses I have incurred because I have been unable to refinance my house because he is on it and won't sign. I have been stuck paying PMI every month. The total has been about $9000.00 so far. In addition I would never have purchased this house I cannot afford if there was not an understanding that he would be joining me. My question is, can I do this since I have signed the agreement and taken the settlement (moving expenses) from NY?

You have made yourself a real mess.

You need a lawyer in Texas to help you straighten this out...if possible.

I have tried to hire an attorney in Texas, but no one seems to want to deal with interstate divorces. And, I have been told I can't file since he did so first in California. I did have an attorney offer to take the case if my husband would drop it in CA, but he said no. Is there a statute of limitations on long a case can be in-process?
