MY wife wants divorce and we both are ready for filing mutual consent divorce. The time of one year has not elapsed since our marriage and my lawyer is opting for application for waiver, application under sec -14 along with the 1st motion, 2nd motion , affidavits etc. Apart from these documents my lawyer is also opting for an agreement where terms and conditions are mentioned for divorce ( alimony amount) which will be given partially at passing of 1st motion and balance at 2nd motion. The terms of the agreement are also mentioned in 1st and 2nd motion application also. My lawyer has asked my wife to sign all the documents. She is now telling that she doesnt thinks it is necessary to sign the agreement and also the 2nd motion ( upfront). My apprehension and concern is whether she can backtrack from her stance after passing of first motion and dont sign the 2nd motion and resort to other modes of divorce and file any false case on my under section 498? Second whether signing the agreement from her will any way strengthen my case? Third how to safeguard my position if this at all happens.?
