I have primary residence custody of my 16 year old son. He got in trouble athome and instead of taking his punshment of begrounded for his difinti action. he ran to his mom's to avoid it. I have tried going to the police but they could not do anything. My ex said she was going to return him to me but instead she decide to file a petion for custody of him after she gave me custody of him back in Feb 2012. Just to state that there is no adult supervision in her house from 8 am to 11 pm. So if i was 16 i was chose that house to cause there no disapline for making wrong actions. And now my ex left the country for 10 days with her boy friend and now i have no idea where he is staying or able to contact him. So when i went to the police the said that they cant do nothing cause there is a court order statoing that she has custody of him. which there isn't it just a pettion for court. so I was wondering what i can do with him being 16?

Your remedy lies in the court where the custody order was issued.

If you're serious, you'll hire a lawyer and direct the lawyer to petition the court to hold her in contempt.

But, if she just let him stay with you for "safekeeping", you might be barking up the wrong tree.

If she has a court order awarding her custody, which has never been changed, you'll need to petition the court to award you custody.

If you have the court order awarding you custody, hire that lawyer, and "git 'er done"!

Otherwise, ask the lawyer about "other" options, based upon "changed circumstances".

Be careful, because the next thing that USUALLY occurs is the kid will accuse YOU of sexually molesting him, or physically abusing him.

Unless you can produce a court order indicating you are entitled to custody and she isn't then you have no argument to make.
If you have an order showing you have custody and it has the proper court stamps on it then take it with you to the local police.
There are easy ways to remedy this if you have paperwork in order.

I do have the paper work saying i have primary residental custodal parent but we have joint custody. and i have been to the police 3 times and they say with him being 16 he doesn't have to come back that he can choose to stay there.
