My $200 application deposit to be kept as liquidated damages?

Friday: Submitted all paperwork & necessary fees ($15 application fee, $200 application deposit) to Leasing Agency A.

Monday: Approved for apartment through Leasing Agency A, but found one closer to job/home though Leasing Agency B.

Tuesday: Returned to Leasing Agency A for $200 application deposit, but they are claiming under the contract they are entitled to keep is as 'liquidated damages.'

Can they do this? I have not yet submitted my income verification; can I tell them I was fired from my job and as a result, no longer qualify for the apartment? Please help me :(
 
Never leave deposits.
When you do, they are forfeited.
If you have to leave a deposit (which you don't), a $1.00 does the same thing!

thanks for the advice guys.

i turned in a altered income/wage worksheet & they were forced to deny me since i didnt meet the requirements.

i got my $200 application deposit back.

thanks again =)
