Hi,

My ex from whom I am divorced file for a "Motion to set aside general judgement of dissolution of marriage and reinstate proceeding" because she want to get back custody of our child and some parenting time. She lose custody and parenting time because she did not attend our trial hearing two consecutive times. I believe she was under the influence of drugs, given that she is an addict. I believe this is probably the is the reason why she missed trial.

In any case she wants to default the judgement saying that I omitted my assets. She wants me to provide assets from my current partner and not just mine. Why do I need to provide the assets from my partner?

She also asked for production of documents in which I suppose to include several documents from both me and my partner. Am I obligated to provide documents from my partner? Documents requested are listed below, I am wondering if I am obligated to provide all of them.

Taxes,
Income forms (wage statements, paycheck stubs)
Checking and bank accounts
Expenses receipts
Purchase receipts
Insurance policies
Travel expenses
Loan documents
Utility bill

Thanks,

Do you have an attorney - it would be best if you discussed this with him/her.

Your partner's assets, earnings, holdings, etc... aren't relevant to anything that concerns you and your former spouse.

But, here's your problem.

You make ONE misstep and WHAM, you've opened yourself up to various and sundry problems.

I urge you to retain a lawyer.

It'll cost you much less than any potential misstep.

It'll also eliminate these shenanigans.

In SOME cases, your attorney can go after her for his or her fees.
I say that in complete ignorance of what she's trying to achieve, or how she's going about it.

So, the real victory is in exposing and stopping her continued harassment of you and your family.

One word of caution, please done mention things you only suspect.
You're probably right, but don't give her any ammunition to attack you.

See about hiring an attorney and defeat this monster. Good luck.

Thank you very much for your response. I understand the need for an attorney but I don't make enough money to pay one right now and I am not getting any child support from my ex either. I care for the kids on my own with my partner help. A friend told me about this site and said it was very helpful so I am hoping to get answers to my questions here.

Again, I really appreciate all the help I can get.

Thanks,
