Through the last year and a half after turning 18 I have gotten myself into some debt. Although the amounts are not absurd, they aren't within my ability to pay off. My situation is that I was let go from my primary employer in late Feb 2006 and was hired to do very sporadic work, mostly weekends, for another company in April at most working 20hrs a couple weeks a month. With the recent boom in unemployment locally there are just no opprotunities within a reasonable distance. There is no work - period.

After receiving several harassing phone calls where I was screamed at, called back immediately after being hung up on, threatened with more harassment if I didn't pay my debt and so forth from creditors with which I have outstanding debts, I recently sent out cease and desist letters to stop the calls in turn prompting them to invoke their normal "legal remedies" under these circumstances. Today I received a letter in the mail from a law firm giving me my 30 day notice to dispute the validity of my debt. After reading posts I take it that the general consensus is to send a letter asking for debt validation? Is there anything else I should be doing?

Now my concern is that I do not make enough for my income to be garnished (id est I have absolutely no work for all of January) nor do I have any seizable assets (real estate, automobile, stock, etc) mentioned in many user responses. What typically happens in a situation like mine?

Standard answer on expired SOL (statute of limitation) and/or validation and/or dispute letters. There are thousands of posts similar to yours on this forum so I have prepared a standard answer.

SOL (Statutes of limitation are DEFENSES to lawsuits; they do NOT provide a method to stop someone from suing you. This defense means when they sue you, you answer with the defense that it is barred by the SOL.)

Make sure you ask for VALIDATION (and do not accept verification).

Sometimes errors are easy to remove and sometimes they stick like glue. It is inexpensive to try and not difficult.

Ask for them to validate the debt, then basically wait for them to decide if they are going to sue you or not. The minimum weekly wage that can be garnished is 154.50, before taxes. If you really have no assets or means to pay this off, the judgment will stay in place for 20 years, then another 20 if they make a motion to extend, so more than likely you will have the means to pay this off sometime in the next 40 years. Just remember, by not paying now, interest will accrue.

Debt Helper - If they do decide to persue it, it's alright by me. As I said, I have no seizable assets. This past year's been very humbling and I do look forward to the day in the near future when I will be able to make good on these debts.
