My dog was attacked

My jurisdiction is: Waco, Tx

This past Friday my Chihuahua was attacked by a pitbull. My dog was on a lead in my yard to potty. The pitbull was from a block down the street and came out of nowhere. I was sitting on my porch with my dog when it happened. I have repeatedly tried to contact the owner of the pit with no response. He did reclaim the dog the next day from the pound and told the animal control officer that "his dog don't bite"! My dog ended up with a double hurnia and a tear in his intestine and had to have emergency surgery. I had to pay over $900 to save my dog. My question is what is the first steps to take legal action? It just makes me mad because pits get a bad rep because of people like this. Even though this dog was trying to kill my dog we still didn't want to hurt or kill his dog. I think the least he could do is talk to us!
 
Typical pit owner, there dogs are mean and they are in totally in denail. You need to sue him in small claims. You have a great case. You also need to file a complaint with animal control. He should be fined for not having any control over his dog.
 
I called animal control and they picked up his dog. He was up there the very next day to reclaim his dog. So now my kids and myself are scared to even go outside! And to top it off, animal control wont give me any information. Name or anything. All I have is his address.
