My dad passed away and left no will. He told me to use his his bank card as credit card while I was doing his hospice care in my home. His mind went suddenly and he couldn't even remember his PIN number . He told me that he wanted me to have what ever cash was left after he was gone . The bank changed his money market account to a checking account . Now the credit card no longer works , the bank sent a notice telling him to call and order a new card. This requires a PIN number of course . How do I go about legally obtaining the Money from the bank? Will I need a lawyer? There is only about ten thousand in the account . I hole you can help me . My husband is without a job. I missed months of work while caring for my dad. We really need. This money. Thank you ! Resa

Sorry, it appears you have been embezzling from his estate. Any other heirs may push to have you punished or prosecuted. Someone needs to become court appointed executor and probate his estate. If that is the only asset, you can contact the bank and see if the account has you as beneficiary.

As disagreeable noted, you can see if you "might" be beneficiary on the bank account. If not (there is no bene), someone will have to open probate of the estate. There may be other family members entitled to a share of his money (assets). If your Dad wanted you to have the balance when he passed away, he should have set something up to that effect (while competent) such as a will as an example.

It "sounds like" he has no surviving spouse - are there other children?
