He and my mother got married back in the 60's & had 3 sons together. In the mid 70's they got a divorce. We haven't seen him since the 70's. 3 years ago I ran a internet search for him, and found out he died in the 90's. They had a divorce decree with the 3 of our names on it as his heirs, and that child support for the 3 of us was to be addressed later by the courts. We are all adults now, but we never received any child support, and I found out that the group that he sung with is still receiving royalty checks. I've been in contact with the attorney that's collecting & distributing the checks for the group to make him aware of our heirship, but all I've been getting from him is the run around & offers of monies that we refuse to accept. He has offered us 1/3rd of these monies after his fees (20-25%) but all the checks we received were for 1/9 because he says my dad had other children, but they were'nt proven to be his heirs, but they're still getting money. I've been trying to fix this situation for 3 years now without filing a lawsuit, but now I'm considering it, and I wanna know how to go about this procedure. I have all the documents that'll establish ours rights as his heirs. Such as my birth certificate with his name on it, my parents marriage license & their divorce decree with the 3 of our names on it. I need some advice as to what to do to get back what's been rightfully ours all of our lives that we never knew about. Please help us with some feedback & advice... I thank you in advance
 
CS is not owed to you, it was owed to your mother. If she never filed for it she probably is not entitled to anything this late in the game.

As far as rights to his estate or royalty checks, sounds like you really need to see an attorney.
