Today my girlfriend and I were caught shoplifting $108 of merchandise from a major department store in our area of NY. Shes 19 and I'm 22. This is the first time getting arrested for both of us. I have been previously charged with an open container at age 18 (paid the fine, case closed), and disorderly conduct at age 20 (out-of-state, NJ, paid the fine, case closed). Neither of these charges were misdemeanors. What should we do? Should we get our own lawyer, or should we get a public defender? What kind of sentence are either of us looking at?
Is jail time (my BIGGEST concern) at all a possibility? If so, what is the likelihood?
Will my prior charges be taken into great consideration? How much would a lawyer typically charge for a petty larceny case such as this?
Please help, this is the only time either of us has ever done something like this, and we were being stupid, idiotic kids. We have very much learned our lesson, but are (obviously) concerned about the repercussions. Any answers to the above questions would be DEEPLY appreciated. Thanks so much...
