My mother died-her boyfriend has everything

My mother recently died in May of 2007. She left behind A twenty year old son, two twin teenage girls, and a twelve year old son. Since then my siblings and I have been trying to contact her former fiance' about getting her things. The first couple of times we talked, he told me that of course we would be getting her things, because by all rights they belong to us. Since then every time i call and leave a message I get no returned call. Her ashes, our baby pictures, her cook books, our family antiques everything is with him. He lives about an hour away, so I can't really just stop over and hope that he's home. Anyway i have no idea how to go about returning her things to her family, they weren't married so I don't see how he could possibly have any legal rights over her possessions. We need help.
 
You need to open a probate estate and have the court summons him to court to tell what he did with the stuff.
 
How would I go about doing that? What does it entail? We don't really have any money and neither did she.

You need to hire a lawyer to open an estate.

If there's no money involved, then you may just have to forget it.
