Can a husband, while going trough a divorce, take a womans children away from her because she is dating a registered sex offender(the offense was with a 15 year old girl when he was 17 and the conviction was in the state of Indiana and he is now 26, and the charge was misconduct with a minor) can someone please help me?
 
Are the children also the husband's children? How old are the children?

What are the conditions of this guy's probation?

Can the husband show that the boyfriend is a danger to the children?
 
Also....

If the children are the husband's, are there any temporary orders in place regarding custody during the divorce proceedings?

Is the wife aware that adultery is grounds for divorce in Texas, and can affect property division and custody? Even though she's divorcing, she's still married until the final decree.

Well...The hubby can't take the MOTHERS children "away". BUT he most certainly can file for custody of his own children if the mother is exposing them to a registered sex offender.

Mom would be really dumb to risk custody of her (plural) children because of some bed-buddy.

First of all it is unusual that sex between a 17 yr old and 15 yr old is even a crime. Are you aur you have the conviction right and the age?

Sexual misc with a minor does not mean he is a threat to the kids but mom is using poor judgement. Dad is free too voice his concern and ask that this man not be around the children. Mom though needs to use better judgement here. She is not even divorced yet and already dating a guy who technically is a sex offender. I cannot possible see how this is going to help her.

OP..back off from this whole scenario. You do not need to interfere with this woman who is not even divorced yet. Your background is going to give her problems. Yes the ex husband is sure free to raise a stink over you. I do not think ANY parent would sit back and allow the other parent to date a sex offender even if this person was supposedly no risk to the kids.

No, the "ex" husband can't just "take" their children from his "ex" wife, LEGALLY.

But, the court can order that the "ex" wife lose custody of their children, if the "ex" husband convinces the court that the children are living in a dangerous, deadly, or compromising situation.

One of those "dangerous" situations "MIGHT" be if the "ex" wife were cohabiting with a "CONVICTED sex offender" or "CONVICTED child molester".

OK seriously guys?

17 year old did something with 15 year old almost ten years ago. Misconduct with a minor.

I would be frankly completely astonished if this resulted in Momma losing custody.

This is not a case of 26 year old playing with a 10 year old. There is a difference and again I'd be amazed if this would be held against Mom to any meaningful degree.

HOWEVER.

OP - if it's your past you're worried about, stick to dating Mom. Do not move in. Do not allow yourself to be around the kids unattended.

In fact you should rethink dating Mom AT ALL while she's still married. Period.
