My sister and I are the only two children of my father who passed away in 1987. He left behind a wife, our stepmother, and the two of us. I am 46 and my sister is 47 and she lives in Ky, while I reside here in Los Angeles. My father didn't have a will, died unexpectantly of a heart attack. Our stepmother "Margie" was a little "strange" but that's beside the point. She flew through his pension and life insurance and we were told when she dies the house would be split between the two of us. My sister and I accepted this and 16 years passes before "Margie" dies in 2004. During that time, Margie was out of it in a nursing home most of the time and was going to leave the house to some woman on her street named "Bunny" and my sister called me to tell me she would do "whatever it takes" to get the house left to her and I or at least to her so we could finally get what was coming to us after our fathers death. My sister and I have had this well known family verbal aggreement since the funeral of my father. My sister did convince Margie to leave the house to her, knowing my interest would be protected by my only blood living sister I agreed to this and time went on. My sister and I had a dispute at which time Margie passes away in 2004 and my sister sold the house. But instead of doing what we had agreed upon for 16 years, she kept all the money and told me last year after we "made up" there was no money left. That isn't the case. I recently traveled to Louisville and found indeed there was money left over. The house sold for 95K and they told Margie while she was in the nursing home they and spent 40K on repairs which is so noted in the transfer papers in the deeds and records building in Ky. The money left over ...I have no idea. She will not talk to me now that I've told her I know about the excess cash and I'm wondering what's next? Do I have any recourse since there was no will? Is our verbal agreement which is well known by every family member worth anything? How much time is left before the statute of limitations runs out? Or is there no time limit?
I'm not sure what to do. I want my fair share.,,,even if it was only 10 grand. I am my fathers only son, she is my only sister.
