My 23 year old unmarried son committed suicide last October. He was a full time student with a part time job. He had a $7000 private school loan with no co-signer. He had a joint bank account with me (his mother) that had a about $500 in it and an additional account in his name only which had $5200 in it. I transferred the money from the individual account to the joint account and withdrew the money to pay for funeral expenses and his apartment lease expenses. This left no estate. There is no will and no executor. In TX it costs about $1500 to $2000 to be named administrator of an estate. I saw no reason to do this when there was no estate.

We received a letter from a collection agency addressed to the estate of my son. They are pursuing payment of the loan.

What should I do? Will I have to pay back the money from his individual account used for funeral expenses and his apartment lease expenses? Can they access the account activity?

Are we responsible for this debt in any way?

How do you stop the collection agency?

I have never heard of it costs 1500 to 2000 to be named the administrator of an estate unless you retain an attorney to do it for you. I would send them a copy of his death certificate and tell them that there is no estate.

In Denton County, TX you can not become an administrator w/o an attorney

The county has set fees for this service. After contacting the court and an attorney we were told it would cost $1500 to $2000.

A death certificate was sent immediately upon receipt of said certificate. They are choosing to pursue this anyway.

What do I do?

Ignore them. Then if they want to pursue it they will have to file to be named as the PR of the estate.
