Shoplifting, Larceny, Robbery, Theft My story

I was on tour with my band and got caught shoplifting in Florence, KY from Store name. I didn't struggle, I was very cooperative with everyone. I got brought to the jail, paid $150 bail and have a court date for an arrainment on Thursday. I've talked to a lawyer about him helping me get this taken care of without me being there but he won't give me anymore answers unless I give him an attorney's fee of $500 which is understandable. I asked him if I should just go to the court date on my own without him and he says "well then I don't know what they'll do to you". I figure he's just trying to play his part of lawyer to get his $$$. Also understandable. Anyways, what I took was about $35. I've got a clean record. I was very cooperative. My question is when I go in, what's more likely to happen? I've been told suspended sentence, to community service to jail. Other lawyers say its unlikely that they'll put me in jail for a first offense for that amount. Any help/suggestions/ideas/stories are welcome.

I'd also read a lot of the other threads here but its a little harder since I'm on my phone. Forgive me as I'm sure this story has been told before!
 
It is never a wise idea to face court without an Attorney. You dont know the Judge, the laws or, plea options. If you cannot afford an Attorney then request a public defender but dont so this without an Attorney. When you meet with your Attorney ask if Diversion is an option in your case

Well this is just an arrainment. And I'm from out of state. I don't have a lawyer and if I go to the arrainment do I request a public defender before I see the judge? I'm sorry for my ignorance on all of this.
 
Courts vary so call see if you can request the PD before court. If not plead not guilty (or enter no plea) and request Public Defender
 
With my clean record and other stuff I've said, is it LIKELY that I'll just get probation or something other than jail? Most people I've talked to seem to think I'll be fine.
 
"Most" people being who with what background and knowledge in this area of law? Can I assume you plan to deal with this without the aid of an Attorney?

I've called other lawyers in the area. They have all said noone goes to jail for what I've done.

I would like a lawyer but like you said I need to call ahead to get a public defender because I assume I can't just go to the arrainment and hold up a sign.
 
I doubt these Lawyers said "no one" goes to jail on first offense. However the likihood of that happenning is very very low. What you need to be concerned about is having a criminal rcord once this is over.
 
Haha well yeah, you're right. They more or less said noone with a clean record and the circumstances go to jail. I've found the number for the public defenders office so I'll be calling them in the morning. Arrainment on Thursday. Will report with an update. :]
 
So I went in and they set me up for diversion. I have to call on Monday and figure out what exactly they want me to do. They told me possibly community service but they also said there might be other stuff. What else would they make me do??
