My wifes ex forged her name for Credit Card

In 1994 , while my wife was seperated from her soon to be ex-husband, he got a Visa card, with her forged signature. Fast forward to 2008, and Bank of America wants her to pay his bill, $5000.

We have asked for itemized bill statement, proof of her signature, and no response. It feels as if they are just trying to strongarm us into paying a sum they pulled out a hat.

We go to small claims on Sept 9. Ex husband is going to court with us and will be testifying to the truth of the matter. Hopefully, this will solve the matter.

My question is what recourse do we have against BOA. I would like to at least get my attorney fees back for our representation.I know we don't have to have an attorney for small claims, but I won't risk it with Bank of america.

I also need to know statue of limitations for the state of Indiana, if it comes down to using that as a defence.

Any help would be greatly appreciated.
